New F1 visa rules, a shrinking grace period, talk of a $100,000 fee to work after graduation it’s a lot to process while you’re also trying to finish coursework and keep your GPA up.

Here’s the thing: most of what’s floating around on Instagram and WhatsApp groups right now is half-correct at best. The F1 Visa 4-Year Rule, Explained Properly

That system is being retired. The Department of Homeland Security finalized a rule eliminating D/S and replacing it with what’s officially called a Fixed Period of Admission. Starting September 15, 2026, F1 and J1 students will be admitted for the length of their program as listed on their Form I-20, capped at a maximum of four years, plus a short window on either end for arrival and departure.

If you’re already in the US on D/S when this takes effect, you’re not thrown out overnight; you’ll transition into the new system, generally capped at four years from when the rule kicks in. Under the new Fixed Period of Admission rules, once your I-20 program end date approaches and you still need more time- say, your PhD program hasn’t wrapped up, or you’re transitioning from Master’s to PhD status- you have to file an Extension of Stay (EOS) application directly with USCIS before your current authorized period runs out.

Can Master’s Students Extend F1 Visa to Pursue a PhD in US?

Yes, but it has to be planned as its own step, not assumed as a continuation of your Master’s status. Moving from a Master’s to a PhD, even at the same university, usually involves a change in your academic program level, which, under the new rules, can trigger its own set of paperwork and, in some cases, restrictions on program transfers and changes in educational objectives, particularly at the graduate level. If your Master’s timeline and your intended PhD start date are close together, this is exactly the kind of transition where a small delay in filing can create a real gap in your legal status.

Practically, this means the safest approach is to start the conversation with your DSO the moment you’re seriously considering a PhD, not after you’ve been admitted.

F1 Visa 30-Day Grace Period: Less Room to Maneuver

Alongside the fixed admission period, DHS is also reducing the post-completion grace period for F1 students from 60 days to 30 days, bringing it in line with the J1 visa’s existing 30-day window. Some students who remain under legacy D/S protections may still see the old 60-day period for a while, but that’s a shrinking exception rather than something to plan around.

Thirty days is not a lot of breathing room if you’re trying to transition from “just graduated with my Master’s” to “enrolled in a PhD program” or “authorized for OPT.” If your admission letter or your I-20 transfer paperwork is even a couple of weeks late, you can end up in a genuinely stressful spot. What’s notable is that a funded PhD position sits largely outside this particular storm. PhD students are typically funded through assistantships, fellowships, or research grants rather than relying on OPT or H-1B to justify their stay, which makes it a comparatively more stable path right now than betting everything on post-MS employment authorization.

And don’t assume the US is your only serious option: Germany, Ireland, and a handful of other destinations offering tuition-free or low-cost, fully funded PhD tracks with clearer post-study work rights are seeing a genuine rise in interest from Indian students specifically because the US picture has gotten harder to predict.
